DMCA Copyright Policy

Varden Homes respects the intellectual property rights of others and expects users of our services to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond to claims of copyright infringement committed using our services.

Reporting Copyright Infringement

If you believe that content available on or through Varden Homes infringes your copyright, please submit a notification containing the following information to our Designated Agent:

  1. Identification of the copyrighted work - A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
  2. Identification of the infringing material - Information reasonably sufficient to locate the material on our services, such as URLs or other specific details.
  3. Your contact information - Your name, address, telephone number, and email address.
  4. Good faith statement - A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement - A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Signature - A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability.

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification containing:

  1. Identification of removed material - Identification of the material that was removed and the location where it appeared before removal.
  2. Your contact information - Your name, address, telephone number, and email address.
  3. Consent to jurisdiction - A statement that you consent to the jurisdiction of the federal court in your district (or San Francisco, California if you are outside the U.S.) and that you will accept service of process from the party who submitted the original notification.
  4. Good faith statement - A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  5. Signature - Your physical or electronic signature.

Submit counter-notifications to our Designated Agent at the address above. Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If we do not receive notice of a filed court action within 10-14 business days, we may restore the removed content.

Repeat Infringers

In accordance with the DMCA and other applicable law, Varden Homes has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Modifications

Varden Homes reserves the right to modify this DMCA Policy at any time. We will notify users of any material changes by posting the updated policy on our website.
